Our priority is to inspire others with outfits of true Vlisco fabrics. If you want to be featured with friends, make sure they are wearing the true original as well.

By responding #YesVlisco you agree to the use of your Instagram comment(s) and/or your Instagram photograph(s) that you have tagged with the hashtag #VliscoOutfit and/or in relation to which you have responded #YesVlisco (the “Pictures”), subject to the conditions of these Privacy & copyright terms and conditions (the “Terms and Conditions”):

1. Processing and storage of your personal data

1.1    To the extent the Pictures qualify as or contain “personal data” within the meaning of Directive 95/46/EC, Regulation (EU) 2016/679 and implementations thereof under national law (the “Data”), you hereby consent to any acts of processing of the Data by Vlisco Netherlands B.V. and/or Vlisco B.V. (“Vlisco”) that are required for, result from or otherwise take place in connection with the use of the Pictures for the purposes stated in clause 2.1 below. These acts of processing will be performed on the basis of and in accordance with your agreement to these Terms and Conditions.

1.2    Your consent to the acts of processing of your Data as identified in section 1.1 is necessary to participate in the #YesVlisco promotional campaign. Your Pictures will not be used in the #YesVlisco promotional campaign if you do not consent to these Terms and Conditions in its entirety.

1.3    You are allowed at any time to inspect and rectify the Data and you may at any time revoke consent to storage or processing of the Data or otherwise object to the processing and/or storage of your Data by Vlisco. You may exercise these rights by sending an e-mail to [email protected]. Revocation of your consent to any act of processing of your Data shall not affect the legality of such acts performed prior to receipt of the revocation by Vlisco.

1.4    Your Data will be stored and processed in accordance with these Terms and Conditions for the duration of the #YesVlisco promotional campaign and will be promptly removed by Vlisco upon termination of this campaign. Your Data will not be used for automated decision-making or profiling of any kind.

1.5    You have the right to file a complaint about the storage and/or processing of your Data by Vlisco with the privacy authority in your state of domicile. The contact details of the privacy authority in your state of domicile are available at the website of the European Commission.

2. Copyright license

2.1     You grant to all Vlisco group companies, their affiliates, assignees, licensees and customers(“Vlisco Group”) a royalty free, perpetual, worldwide license to use your Instagram comment(s) and/or your Instagram photograph(s) that you have tagged with the hashtag #VliscoOutfit and/or in relation to which you have responded #YesVlisco (the “Pictures”),on any offline and online media including but not limited to Internet (such as social media, blogs, Vlisco related websites), press release, editorial print and online, newsletters, in-store/point of sale materials. Vlisco may use, reproduce, distribute, combine with other materials, alter and/or edit, copy, publish, save, store, archive your Pictures in any manner in its sole discretion, with no obligation to you whatsoever.

2.2     You hereby represent and warrant that (i) you own all rights in and to your Pictures, including Copyright, (ii) you have permission from any person(s) appearing in your Pictures to grant the rights herein, (iii) you have reached the legal age of majority in your jurisdiction of residence, and (iv) Vlisco’s use of your Instagram comments and/or Pictures will not infringe any third party’s right or any law.

2.3     You hereby release, discharge and agree to hold Vlisco and any person acting on behalf of Vlisco harmless from all actions, claims, damages, liabilities, costs and expenses arising out of the use by Vlisco of the Pictures.

2.4     You hereby release and discharge Vlisco from all and any obligation to pay you for any use of your Pictures and any of the intellectual property rights contained therein in connection with the uses described above.

3. Miscellaneous

3.1    If you delete your #YesVlisco approval post, or your Pictures from Instagram, your agreement to these Terms and Conditions is still applicable. Your agreement to these Terms and Conditions can be revoked by sending an email to [email protected], explicitly stating your willingness to revoke your consent to any part of these Terms and Conditions.

3.2    These Terms and Conditions or a [Dutch] translation thereof will be sent to you via email upon your request. You may file such a request by sending an email to contact @vlisco.com.

3.3    These Terms and Conditions are subject to Dutch law.
